General Terms and Conditions for Rental Cottage BERGOV, Stupná 13, Vidochov
These general terms and conditions regulate the mutual contractual relations between the landlord of the cottage BERGOV (hereinafter referred to as the subject of the lease) and the tenant.
The contractual relationship between the landlord and the tenant arises upon crediting the deposit payment by the due date to the landlord’s account specified below.
The subject of the lease is rented as a whole. The operator does not stay in the subject of the lease during your stay, but may visit during the stay to verify compliance with the lease conditions.
Arrival for a weekly stay is always on Saturday from 2:00 PM to 4:00 PM or by agreement, and the stay ends the following Saturday with the cottage being handed back to the landlord from 10:00 AM to 11:00 AM. For other stay periods, arrival is on the start day of the stay from 2:00 PM to 4:00 PM or by agreement, and the cottage is handed back to the landlord on the last day of the stay from 10:00 AM to 11:00 AM or by agreement. The minimum stay duration is 3 nights. Individual agreements are possible.
The tenant is responsible for handing over the subject of the lease in the condition in which it was received, i.e., cleaned (items in their original places, washed kitchen including dishes, clean bathrooms, toilets, vacuumed carpets and mopped floors, and beds stripped). On the day of departure, it is acceptable to place the last used dishes in the dishwasher and turn it on.
Inquiries about availability are accepted via the online reservation system, email, or by phone. Rental orders are always in writing (email: [email protected]). We will promptly inform you whether the requested date is available, and if so, we will reserve this date for you for 7 calendar days. Within this period, it is necessary to pay the deposit by bank transfer in the amount of 50% of the total stay price. If the deposit payment is not made by the above deadline, the preliminary reservation will be canceled, and this date will become available to other clients. The payment date is considered the date when the amount is credited to the landlord’s account. Bank details – account number: 265 165 070/0300 The variable symbol will be provided by the landlord in the deposit invoice. After the deposit payment is made and credited to the account, you will receive an email confirmation of receipt of the deposit payment. From this moment, the order is binding for both the tenant and the landlord. The remaining balance of the rental price must be paid by the tenant no later than 30 days before the booked date. In case of failure to fulfill this obligation, the landlord has the right to withdraw from the contract. In the event of withdrawal from the contract due to the tenant’s failure to fulfill obligations, the deposit paid by the tenant becomes a contractual penalty to cover the costs incurred by the landlord related to the binding reservation. In the case of a “last minute” stay booking, payment is made in full (not divided into deposit and balance).
Cancellation conditions – The tenant may withdraw from the contract without stating reasons, but the landlord has the right to charge cancellation fees. Cancellation must be made by the tenant in writing (email), and the landlord will notify the tenant of the acceptance of the cancellation also in writing (email). The decisive date is the date of receipt of the email. Cancellation of the stay 60 or more days before the start of the stay – no fee. Cancellation of the stay 59-30 days before the start of the stay: 25% of the stay price. Cancellation of the stay 29-14 days before the start of the stay: 50% of the stay price. Cancellation of the stay 13-7 days before the start of the stay: 75% of the stay price. Cancellation of the stay 6 or fewer days before the start of the stay: 100% of the stay price. If the tenant does not arrive and does not occupy the pre-booked cottage within 24 hours of the reserved stay, a cancellation fee of 100% of the stay price will also be charged, and the stay will be canceled without compensation. This does not apply if the tenant notifies the landlord in advance by phone or email of a later arrival and an agreement is reached. If the tenant decides to end their stay before the agreed departure date, they are not entitled to any compensation.
The tenant is obliged to comply with and follow the General Terms and Conditions for the Rental of Cottage BERGOV. The landlord reserves the right to immediately terminate the stay in the event that:
- the number of people arriving for the stay exceeds either the total capacity of the property (max. 10 people) or a higher number of people than agreed upon
- there is an arbitrary increase in the number of people during the stay (without the landlord’s knowledge)
- there is a violation of the smoking ban and the use of open fire (except for the fireplace)
- the presence of any unagreed pet is discovered.
In all cases, there is no right to a refund of the unused rental payment. For safety reasons, do not leave children unsupervised in the property or its immediate surroundings. When using the cottage facilities (pool, sauna, playground, handling the grill, lighting a fire in the fireplace or outdoor fire pit), observe all safety rules. Chopping wood inside the cottage is prohibited. When leaving the property or moving away from it, properly lock it, including closing the windows. Footwear is changed in the cottage; please bring suitable indoor footwear with you. The tenants and their guests must treat the entire cottage premises with all due care. Compensation for damage to the subject of the lease caused by the tenant’s fault will be claimed by the landlord, including any compensation for damage caused by the inability to further use the subject of the lease. The rental price does not include personal insurance. Tenants use the cottage rental at their own risk. The landlord is not responsible for injuries or damage or theft of property. The rental price includes the use of the entire property for a maximum of 10 people for the agreed period, WI-FI, water consumption, electricity consumption, bed linen, dishwasher including tablets, washing machine including detergent, toiletries, wood for the fireplace, unlimited use of the outdoor heated pool (the pool is in operation from May 1 to October 31), unlimited use of the Finnish sauna, dish towels, hand towels at sinks, cleaning products, tourist fee, etc. We do not charge any hidden additional fees!!! Upon arrival for the stay, when taking over the cottage, the tenant must present an identity document. The tenant is responsible for the actions of their guests. Upon arrival, a refundable deposit of 5,000 CZK is paid. Proper termination of the rental and handover of the cottage takes place with the assistance of the landlord or the property manager. Early departure without proper handover of the property means forfeiture of the deposit and subsequent claiming of costs that the tenant caused to the landlord through their stay and actions.
